Welcome to Bondello, a service operated by Samfinity Tech LLC d/b/a Bondello (“Bondello,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our online platform (the “Service”), including the landing pages, campaign creation tools, analytics, and messaging functionality. By using or accessing our Service, you (“you,” “your,” or “Local Business”) agree to be bound by these Terms. If you do not agree, do not use the Service.
We reserve the right to modify these Terms at any time. We will post the updated Terms on our website at https://www.bondello.io. Your continued use of the Service after we post changes constitutes acceptance of those changes.
Location Restriction: The Service is intended for use by businesses located in the United States only.
Age Requirement: You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. The Service is not directed to or intended for use by children under 13 years old.
Bondello provides a platform that enables local businesses (such as restaurants, spas, salons, etc.) to:
We integrate with third-party messaging services (e.g., Twilio, WhatsApp Business API, email service providers) to facilitate communications on your behalf. Bondello does not guarantee any specific results or revenue increases from campaigns or analytics suggestions.
Offers, Promotions & Compliance
Any offers, promotions, discounts, or campaigns you create are solely your responsibility. You must honor and fulfill any promises made to your customers. Bondello is not responsible for any customer complaints, refunds, or chargebacks arising from your campaigns.
You are solely responsible for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act (for emails), and any state-specific marketing or privacy regulations. You must obtain all necessary consents from your customers before sending them promotional messages.
Data Collection & Consent
You are responsible for ensuring that you have a lawful basis (including any required consents) to collect and use customer phone numbers, email addresses, or other personal data.
You must allow end users to opt out of receiving future messages, including SMS “STOP” mechanisms or similar unsubscribing options, as required by law.
Content Control
You are solely responsible for all text, images, logos, offers, or other content (“User Content”) you upload or distribute via the Service. Bondello does not monitor, edit, or endorse any User Content.
You represent and warrant that you own or have the necessary licenses, rights, and consents to publish the User Content and that it does not infringe any third-party rights or violate any law.
Prohibited Businesses
Bondello does not allow campaigns for certain businesses or content, including, but not limited to, adult content and gambling services. Bondello reserves the right to suspend or terminate accounts that violate these restrictions.
Bondello integrates or relies on third-party services (e.g., SMS gateways, WhatsApp APIs, analytics providers) for messaging and data processing. We do not guarantee the continuous, uninterrupted, or secure availability of such third-party services. You agree that Bondello is not liable for any delays, failures, or data breaches originating from these external platforms.
Bondello may enter into separate agreements with local businesses regarding pricing, subscriptions, or usage fees. These Terms do not govern payment or pricing, which are established in separate agreements. You must comply with those agreements for the provision of paid services.
Bondello’s Intellectual Property
The Service, including our trademarks, logos, and any software or content provided by Bondello, are owned by or licensed to Bondello. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
User Content License
You grant Bondello a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display your User Content (such as your logos or marketing materials) solely for the purpose of operating and providing the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BONDELLO DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or secure.
AI-Powered or Analytical Features: Any analytics, forecasts, or suggestions provided by Bondello’s AI or analytics tools are for informational purposes only. We do not guarantee the accuracy of such data or that it will increase your business revenue.
TO THE MAXIMUM EXTENT ALLOWED BY LAW, BONDELLO (INCLUDING OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE (WHETHER DIRECT OR INDIRECT), OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BONDELLO’S TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT THAT GAVE RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless Bondello and its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from or related to:
Governing Law: These Terms and any dispute arising hereunder shall be governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.
Venue: Any dispute or claim shall be resolved in a court of competent jurisdiction located in New Jersey, and you consent to the exclusive jurisdiction of such courts.
Class Action Waiver: To the extent permissible by law, you agree to resolve any disputes on an individual basis and waive any right to pursue claims as part of a class action.
Bondello may terminate or suspend your access to the Service at any time, with or without cause, including if you violate these Terms, engage in fraudulent or illegal activities, or if required by law. Upon termination, your right to use the Service will immediately cease.
No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of future enforcement of that right or provision.
Severability: If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with any separate written agreement (e.g., subscription agreement) you have with Bondello, constitute the entire agreement between you and Bondello concerning your use of the Service.
